In plain words: Dindom is an app that connects passengers in Cobija with independent drivers, and connects customers with local stores for delivery. Dindom does not drive, deliver or sell the products itself. You pay the ride or order directly to the driver; Dindom charges its own service commission to drivers and stores through their Dindom wallets. This summary does not replace the full Terms below.
1. Acceptance of these Terms
These Terms of Use ("Terms") govern your access to and use of the Dindom mobile application, the Dindom store partner panel and their related services (together, the "Service"), operated in and around Cobija, Pando, Bolivia ("Dindom", "we", "us"). By creating an account, signing in, or otherwise using the Service, you confirm that you have read and agree to these Terms, to our Privacy Policy and to our Conditions of Use. If you do not agree, do not use the Service.
2. Description of the Service
Dindom is a technology platform that allows registered users to:
- Request rides by motorcycle or car ("Passengers") from independent drivers ("Drivers");
- Order products from participating local stores ("Stores") and have them delivered by independent Drivers ("Customers");
- Offer transport and delivery services as an independent Driver, once their profile has been reviewed and approved;
- Sell products through the app as a Store, once the Store's application has been reviewed and approved;
- Use complementary features such as in-app chat, ratings, announcements and the Moto Rush Cobija game.
Dindom is an intermediary. It does not own vehicles, does not employ Drivers, and does not prepare, sell or guarantee the products offered by Stores. The availability of Drivers and Stores depends on them and may vary by time of day, weather, demand and other factors.
3. Eligibility and accounts
- You must be at least 18 years old to create an account. The Service is not directed to, and may not be used by, anyone under 18.
- Accounts are created and accessed by signing in with a Google account ("Sign in with Google"). Dindom does not create or store passwords of its own.
- Each person may hold only one account. You may not create accounts on behalf of others, share your account, or sell or transfer it.
- You must provide true and current information (full name, mobile phone number and, where required, identity and vehicle documents) and keep it up to date.
- You are responsible for keeping control of the Google account and the device linked to your Dindom account, and for all activity that happens under it. The optional fingerprint lock in the app is an extra protection on your device, not a substitute for protecting your Google account.
- Tell us right away at the contact address in Section 25 if you lose access to your Google account or believe someone else is using your Dindom account.
4. Requesting and taking rides
- When you request a ride, the app shows a suggested fare calculated from the distance of the route and the prices set for your city. Depending on the version of the app, Passengers and Drivers may propose a different amount through the app; the fare of each ride is the amount both accept before the ride starts.
- You must set a real pickup point and destination, be at the pickup point on time, and travel only with the number of people and luggage the vehicle can safely carry.
- Either party may cancel a request before the ride starts. Frequent cancellations, no-shows or cancellations made only to obtain a different price may affect your account, as described in Section 19.
- The Driver is responsible for driving safely and lawfully. The Passenger must behave respectfully, follow the Driver's reasonable safety instructions (for example, wearing the helmet provided on a motorcycle) and not ask the Driver to break traffic rules.
- Dindom is not responsible for items left in a vehicle. If you lose something, contact the Driver through the app or write to us, and we will try to help connect you.
- Estimated arrival times, distances and routes are approximate and may change due to traffic, roadworks, weather or other circumstances.
5. Store orders and deliveries
- Products, prices, descriptions, photos, opening hours and availability are published by each Store, which is solely responsible for them, for the quality, safety and legality of what it sells, and for issuing any receipt or invoice required by law.
- The order total shown in the app includes the products and, where applicable, the delivery fee. The delivery fee is calculated from the distance between the Store and your address.
- Pharmacies and other regulated Stores must comply with the rules that apply to their products (for example, products that require a prescription). Dindom may refuse or remove products that it reasonably believes are illegal or unsafe.
- You must give a correct delivery address, be reachable by phone and be available to receive the order. An order may not be cancellable once the Store has accepted it or started preparing it.
- If an order arrives incomplete, damaged or different from what you ordered, report it through the app or to our contact address as soon as possible so we can review it with the Store and the Driver.
6. User conduct
When using the Service, you agree not to:
- Provide false identity, vehicle, store or document information, or impersonate another person;
- Use the Service for illegal, fraudulent or unsafe purposes, including transporting prohibited goods;
- Harass, threaten, insult, discriminate against or harm other users, Drivers or Store staff;
- Send unlawful, violent, sexual, hateful or misleading content through the chat, voice notes, photos, ratings or reports;
- Misuse the SOS or emergency features, or file false reports against other users;
- Try to bypass the Dindom wallets to avoid commissions, or manipulate ratings, offers, promotions, balance gifts or game scores;
- Use bots, scripts or modified versions of the app, interfere with the normal operation of the Service, or try to access accounts, data or administrative tools that are not yours.
We may investigate reports of misconduct and take the measures described in Section 19.
7. Specific terms for Drivers
Independent providers. Drivers are independent providers of transport and delivery services. Nothing in these Terms creates an employment, agency, partnership or joint-venture relationship between Dindom and any Driver. Drivers choose when to connect and decide whether to accept each request.
Documents and vehicle. Drivers declare that they hold a valid driver's license for the type of vehicle they use, that the vehicle is roadworthy, properly registered and carries the insurance required by Bolivian law (such as SOAT), and that every document and photo uploaded for verification is genuine and current. Dindom may approve, reject or suspend a Driver profile, and may ask for updated documents at any time.
Going online. Drivers should go online only when they can really take requests. While online, the app uses the Driver's location, including in the background, to send nearby requests and show the Driver on the map (see the Privacy Policy). Declining or ignoring requests repeatedly may lower the Driver's score.
Conduct. Drivers are solely responsible for their own conduct, for complying with Bolivian traffic and transport regulations, for charging only the agreed amount, and for using the drivers' group chat and SOS features responsibly.
8. Specific terms for Stores
- Stores apply through Dindom's private application form and must provide true information and valid documents (such as identity documents of the owner, tax registration (NIT), business license and, where applicable, health or pharmacy authorizations). Dindom may approve or reject any application.
- Approved Stores manage their products, prices, hours and orders through the store partner panel, accessed with the Google account used in the application. The Store is responsible for keeping that Google account secure.
- Stores must keep their information accurate, prepare orders correctly and on time, and comply with all laws that apply to their business, including consumer protection, health and tax rules.
- Stores keep a Dindom store wallet used to pay Dindom's commission on completed orders, under the terms of Section 9.
- Dindom may hide, suspend or remove a Store, or individual products, for breach of these Terms or when required by law.
9. Fares, payments, commissions and wallets
- Payment for a ride or an order is made directly between the Passenger or Customer and the Driver (and, for orders, the Store), in cash or by QR or any other means they agree. Dindom does not collect, hold or process the Passenger's or Customer's payment.
- A ride or delivery may be agreed at any amount the parties accept, including free of charge. Dindom does not charge a commission on rides or deliveries agreed at no cost.
- Drivers and Stores keep separate Dindom wallets used only to pay Dindom's service commission. When a paid ride or order is completed, Dindom automatically deducts its commission from the corresponding wallet. Commission rates are set for each city and shown to Drivers and Stores in the app; in Cobija they are currently 15% of the amount for Drivers and 10% of the products' value for Stores. The commission is not an additional charge to the Passenger or Customer.
- Wallets are topped up by sending a recharge (for example, a QR payment receipt), which a Dindom administrator reviews before crediting it. Dindom may reject a recharge it cannot verify.
- Drivers must keep the minimum wallet balance set for their city (currently Bs 10 in Cobija) to be able to go online and receive requests. Stores must keep the minimum store wallet balance set for their city (currently Bs 10 in Cobija); below it, the Store appears closed in the app until it tops up.
- Wallet balances have no cash value outside the Service, cannot be transferred between accounts, and are not refundable, except where Bolivian law requires otherwise or where Dindom decides to credit a balance (for example, a balance gift).
- As a consumer, you keep the rights granted by Bolivia's Law No. 453 (General Law on the Rights of Users and Consumers), including the right to file a complaint about a service you paid for.
11. In-app communications
The Service includes a chat between the Passenger or Customer and the Driver of an active ride or order, with text, voice notes, photos and videos, phone calls, and a group chat for approved Drivers with an SOS button. You are responsible for what you send. Messages may be reviewed by Dindom when a user reports them, when there is an SOS alert, or when needed to investigate a breach of these Terms or a safety incident. Dindom may remove content and close conversations that breach these Terms. We may also send you service messages and announcements inside the app.
12. Ratings, reports and user content
Passengers, Customers and Drivers can rate each other and send reports and bug reports. Everything you submit must be true to the best of your knowledge and must not defame, harass or misrepresent another person. You keep ownership of the content you send, but you grant Dindom a non-exclusive, free license to store, display and use it as needed to operate, protect and improve the Service. Dindom may remove content or ratings it reasonably believes were submitted in bad faith.
13. Location and device permissions
Some features need permissions on your phone: location (to set pickup points and addresses, connect you with nearby Drivers and show live tracking; for Drivers, also in the background while they are online), the camera and photos (profile photo, documents, chat images), the microphone (voice notes) and your phone's fingerprint feature (optional app lock). You can deny or revoke permissions in your phone's settings, but some features will then not work.
14. Intellectual property
The Dindom name and logo, the Moto Rush Cobija game, and the software, design and content of the app, the website and the store partner panel are the property of Dindom or its licensors. You are granted a limited, revocable, non-exclusive and non-transferable license to use the app for its intended purpose. You may not copy, modify, reverse engineer, resell or create derivative works of the Service, except as permitted by applicable law. Store names, logos and product photos belong to each Store, which authorizes Dindom to display them in the Service.
15. Third-party services
The Service relies on third-party services, such as Google (sign-in, maps, place search and routes), open routing services, hosting providers and the operating system of your phone. Their use is also subject to their own terms and privacy policies. Dindom is not responsible for interruptions or errors caused by those services, by your mobile network or by your device.
16. Disclaimer of warranties
The Service is provided "as is" and "as available". Dindom does not guarantee that a ride, an order, a Driver or a Store will always be available, that estimated times, distances or fares will be exact, or that the Service will work without interruptions or errors. Dindom does not control, and is not responsible for, the quality, safety or legality of products sold by Stores, or the way an independent Driver operates their vehicle.
17. Limitation of liability
To the maximum extent permitted by applicable law, Dindom's role and liability are limited to facilitating the connection between Passengers, Customers, Drivers and Stores through the Service. Dindom is not liable for indirect, incidental, special or consequential damages, loss of profits, or for the acts or omissions of independent Drivers, Stores or other users, except where such liability cannot be excluded under Bolivian law. Nothing in these Terms limits any right you have under Law No. 453 that cannot legally be waived.
18. Indemnity
You agree to hold Dindom harmless from claims, damages, losses or expenses arising from your breach of these Terms, your misuse of the Service, the content you send, or your violation of the law or of the rights of others, to the extent permitted by Bolivian law.
19. Suspension, termination and account deletion
- Dindom may warn, temporarily suspend or permanently close an account, Driver profile or Store that breaches these Terms, submits false documents, puts other people at risk, or abuses the wallet, offers, promotions or game. When an account is suspended for a set period, access is restored automatically when that period ends.
- You may stop using the Service at any time and delete your account from the app (Profile › Delete my account) or by writing to us. Pending rides or orders and any wallet balance must be settled first; deleting the account does not cancel debts with other users or with Dindom.
- After deletion we keep only the information we must retain for the reasons explained in the Privacy Policy.
20. Events beyond our control
Dindom is not responsible for failures or delays caused by events beyond its reasonable control, such as natural disasters, floods, storms, blockades, strikes, power or internet outages, failures of third-party services, or orders of public authorities.
21. Governing law and disputes
These Terms are governed by the laws of the Plurinational State of Bolivia. We encourage you to contact us first so we can try to solve any problem directly. Any dispute that cannot be resolved that way will be subject to the competent courts of Cobija, Pando, Bolivia, without prejudice to your right to file a consumer complaint under Law No. 453 before the competent public authority, or a constitutional privacy protection action (Acción de Protección de Privacidad, Arts. 130-131 of the Bolivian Constitution).
CPE Art. 130-131Law No. 453Law No. 164
22. Language
These Terms, the Privacy Policy, the Conditions of Use and the Cookie Policy are published in English only. If you need help understanding any part of them, write to us and we will explain it.
23. General provisions
If any part of these Terms is found invalid or unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, the Conditions of Use and any specific conditions shown in the app, are the entire agreement between you and Dindom about the Service. You may not transfer your rights under these Terms; Dindom may transfer them in connection with a reorganization or sale of the Service, with notice to you.
24. Changes to these Terms
Dindom is a growing service and these Terms may be updated as the Service and the applicable regulation evolve. We will update the effective date above and, for important changes, we will notify users inside the app before the changes take effect. If you keep using the Service after that, you accept the updated Terms.
